The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Holmes County, Ohio. 8. The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it in his estimation prove injurious to the auction. It is Bidder's responsibility to inspect equipment prior to bidding. Sales Tax Exemption - Tax exempt Buyers must present a current and valid exemption certificate at time of registration. Bidding disputes will be settled at the sole discretion of Auctioneer and Auctioneer may put the disputed lot up for sale again to be resold to the highest bidder of the disputing parties. The Auctioneer's decision is final. Purchases become the responsibility of the high bidder immediately upon acceptance of his bid. They shall be and remain at the risk of the buyer. It is the Buyer's responsibility to insure his purchases immediately. No removal of purchases from the auction site will be allowed until stated load out time. Titles ? Seller has up to 21 days to produce valid title. Buyers are encouraged to not spend money on or sell the vehicle until they have the title. Any costs will not be reimbursed if seller is not able to produce title. Buyer is required to notify RES Auction Services of returned items due to no title. If RES does not receive a valid title within the 21 days, they have the option to return the item. In such cases, the buyer is responsible for returning the item in an equal to or better condition than its original state at the time of purchase. Buyer must inform RES of item being returned due to no title. The item must be returned within 5 days of the notification. The seller will be notified that the item is being returned due to no title. If buyer fails to return the item within 5 days and the title is provided within that time, the transaction will be considered valid. It is the Buyer's responsibility to be aware of their local motor vehicle regulations pertaining to titles and registrations prior to purchase of a motor vehicle. Buyer is also advised to take notice of title information noted on each motor vehicle, in the catalog, and as announced by the auctioneer on sale day. There will be a 10% buyer's premium applied to your final bid to determine the final purchase price.
