ALL ITEMS SELL WITHOUT GUARANTEE-- ITEMS SELL AS IS, LIKE IS,
WHERE IS, UPON BUYERS OWN JUDGEMENT. ALL SALES ARE FINAL. No Refunds or Returns.
"Seller disclaims all warranties, expressed or implied, concerning the goods sold hereunder, including, without limitation, all implied warranties of merchantability and fitness." Purchaser agrees to indemnify and hold Merv E. Hilpipre Auction Company and Associates, and all Seller and Associates, harmless from any claims, damages, or losses arising from the sale or use of the goods sold here. Further, Purchaser agrees to indemnify and hold Merv E. Hilpipre Auction Company and Associates, and all Seller and Associates, and Webcast Providers and Associates, harmless from all bidders’ chosen technology devices they use for webcast bidding. Including but not limited to service disconnection, time delay, non-compliant software, inability to access, etc.
The purchaser further agrees to pay for all purchases on the auction day or by the designated date. The buyer also agrees to pay a 15% buyer’s premium. Any buyer paying by credit has to pay an additional 4% handling fee.
Quantity of items per lot. Read the number in the quantity section of the lot carefully. Your bid is times the number in the quantity section. For example, if quantity is listed as “1” and your bid is $10, it means $10 x 1 = $10 for the lot (this total bid is before the applied buyers’ premium of 15%, additionally $20 for purchase of a each firearm and before the 4% credit card fee for credit cards users). These fees will be added to your total when invoiced. Suppose the quantity is listed more than “1,” for example, qty. of 2 and your bid is $10. In that case, it means $10 x 2 total bid for the lot would be $20 (this total bid is before the applied buyers’ premium of 15% and additionally $20 for purchase of each firearm before the 4% credit card fee for credit cards users). These fees will be added to your total when invoiced.

The auctioneer assumes no responsibility for typographical or other errors that may appear herein (on each description or other information). All descriptions, machine specifications, serial numbers, etc., are believed to be correct but are used only as a guide and are not guaranteed.

The auctioneer has the sole discretionary power to, but not limited to, bid increments, bid calling, and determining which bidder and the sale amount for each lot.
Payment Info:
Announcements made on the day of the auction supersede previous announcements.
ALL Purchasers. Please email us no later than one hour after receiving your invoice on the auction day to specify if payment will be made remotely or in person. All buyers must make payment before scheduling a pickup appointment.
PAYMENT: US FUNDS ONLY –Wire Transfer, Cashier check (for remote payment, must be mailed by overnight carrier), or Credit Card with an additional 4% fee, OR Cash (In-person payment only), NO CHECKS!!!
Additional terms for credit card charges: There is a NO CHARGEBACK PROVISION. The bidder / Buyer agrees he/she will not initiate a chargeback under any circumstances, waiving such rights that may exist under the agreement between the bidder/buyer and credit card companies. The buyer/bidder further agrees should a chargeback be initiated, the bidder/buyer's terms and conditions will be conclusive evidence of the bidder’s waiver. If a chargeback is successful, the buyer remains liable for the purchase price plus the cost of collection, including attorneys’ fees.
Buyers’ Premium 15% applies on all purchases.
In-Person PAYMENTS: Purchasers can make in-person payments at the Hilpipre Auction Co. facility, 2862 Wagner Rd., Waterloo, IA.
REMOTE PAYMENTS:
All remote payments must be made no later than Wednesday, JULY 17, 2024, by 2:00 pm.

All purchasers MUST pick up purchases in person. There will be NO SHIPPING.
The purchaser is FULLY responsible for arranging their pickup, packaging, and removal.
The buyer assumes all risk of loss when the item is sold. The relationship between the Auction Co. and the buyer is not a bailment. All Merchandise is sold as is, where is, and no warranties are in effect!
Remove all items per the directed removal dates.

A photo ID will be required to pick up purchases.

TERMS & CONDITIONS OF SALE
1. The Auctioneer will announce whether the auction is with or without reserve. All rights of the auctioneer and the purchaser shall be in force depending on the type of auction. Announcements made during the sale supersede any previous, spoken, or printed announcements. Any persons selling or consigning items to the sale shall not bid on said items or is not allowed to have an associate or agent bid for them.
2. Any person desiring to procure any bids shall register with the Auction Co. Registering will consist of providing all necessary information requested by the Auction Co. All persons registering guarantee that the provided information is accurate and warrant that they are authorized to bid on behalf of the firm or party represented. Auctioneers or Auction Co. reserve the right to refuse any applicant a bidding card and may revoke such privilege at any time.
3. All purchases must be settled in full on the day of the sale and removed from the premises within the time specified by the auctioneer. Payment shall be in cash, cashier checks, or credit cards, with an additional fee or checks. Checks must be accompanied by a bank letter of credit guaranteeing the check. Auctioneers or Auction Co. will have the sole right to determine if a person does not need to provide a letter of credit or if payment may be delayed. By bidding on items in the auction, the buyer represents to auctioneers that he is financially solvent and that all checks issued by the buyer will be honored. A dishonored check proves the buyer is insolvent and entitles the auctioneer to remedies available under applicable laws.
4. All goods will be divided into lots and sold to the highest bidder for cash. When questions arise regarding the price for which lots have been sold, the record kept by the clerk of sale and the marked catalog of the Auctioneer shall, in all cases, be accepted by the buyers as final.
5. Auctioneers reserve the sole right to change the sale order, the lots' size, and the addition or subtraction of a lot number. They will also have the sole right to determine the bidding increment. In the event of a buyers’ dispute or tie bid, the Auctioneer has the sole right to either open up the bidding for continued advancement or strike the goods sold. Auctioneers reserve the right to refuse any bid they consider an insignificant advance over the preceding bid.
6. Any errors in accounting regarding the purchaser's bill will be corrected according to the facts. The purchaser agrees to pay what is owed. The purchaser shall not be entitled to possession of any of his purchases until the total purchase price of all his items has been paid in full. In the event the purchaser fails to pay the total purchase price of any lot within the prescribed time or fails to compile with any terms of sale, Auctioneers shall have retained a possessory lien on all lots of the purchaser and, at their sole discretion, have the right to resell such lots by public or private sale without notice of any kind to purchaser.
7. Any printed literature given to purchasers, such as a buyer's catalog, shall only be a guide. If Auctioneers express an opinion on condition or merchantability and what price should be paid, no sale shall be invalidated because of any defect or inaccuracy in any of the lots because they are inaccurately described in this listing catalog or elsewhere; no liability shall be borne by the Auctioneer regarding any such faults or errors.
8. Purchaser acknowledges and agrees that all goods have been available before sale time and that he is purchasing all goods with all defects. DO NOT BID UNLESS YOU HAVE DETERMINED THE CONDITION OF THE LOT FROM YOUR EXAMINATION. Buyer acknowledges sole responsibility and assumes the risk that a lot after it has been inspected might change. The auctioneer will sell the lot(s) as it exists at the time sold, as is, where is, with no warranties, whether implied or expressed. Any warranties or guarantees will be between the buyer and seller only.
8. The auction sale site shall include any location where a lot is located for display and/or removal. The actual bid calling could be at the auction site or at a designated location the auctioneer decides. Auction sales sites are considered potentially dangerous places, and immediately upon registration, if not before, the purchaser shall notify agents, servants, employees, and others accompanying him.
